Acceptable Use Policy

5.1 Purpose
This Acceptable Use Policy ("AUP") defines the standards of conduct expected of all users of the UGC Travel SaaS Platform ("Platform"). The AUP is incorporated by reference into the Terms of Service and constitutes a binding part of your agreement with [COMPANY NAME] ("Company," "we," "us").
The Platform is designed exclusively for lawful B2B business prospection by content creators and marketing professionals. All use must be consistent with this purpose.
5.2 Permitted Uses
You may use the Platform to:
- Search for and identify hospitality establishments (hotels, restaurants, villas, and similar) as potential business partners;
- Review publicly available contact information associated with those establishments;
- Compose and send professional business prospection emails to establishment representatives on behalf of your own professional activity;
- Manage your prospection campaigns, templates, and contact history;
- Export establishment lists for your own internal business use.
All use must comply with applicable laws in your jurisdiction and in the jurisdiction of any recipient.
5.3 Prohibited Uses
5.3.1 Prohibited email practices
You must not use the Platform to:
- Send unsolicited bulk email ("spam") as defined by applicable anti-spam law;
- Send emails without a clear sender identification, genuine subject line, or functional unsubscribe mechanism;
- Send emails that impersonate any person, organization, or brand;
- Send emails containing deceptive, misleading, defamatory, threatening, or harassing content;
- Send emails that violate intellectual property rights or include unlicensed content;
- Continue sending emails to any recipient who has requested to opt out.
5.3.2 Prohibited data practices
You must not:
- Use establishment contact data to target consumers (private individuals) rather than business representatives;
- Aggregate, re-sell, or create derivative databases from data obtained via the Platform;
- Combine Platform data with other data sources to create personal profiles of individuals in a manner inconsistent with data protection law;
- Upload to the Platform any personal data for which you do not have a lawful basis to process.
5.3.3 Prohibited technical conduct
You must not:
- Bypass, circumvent, or attempt to defeat any security or authentication feature;
- Access the Platform through automated means (bots, scrapers, crawlers) beyond any API access explicitly authorized in writing;
- Probe, scan, or test the vulnerability of the Platform or its infrastructure;
- Introduce malicious code, viruses, or any technologically harmful material;
- Attempt to gain access to accounts, data, or systems other than your own;
- Overload the Platform's infrastructure through excessive automated requests;
- Use the Platform in a manner that disrupts or degrades service for other users.
5.3.4 Prohibited content
User Content (email templates, profile information, uploaded materials) must not:
- Be unlawful, defamatory, obscene, offensive, or threatening;
- Infringe any patent, trademark, copyright, trade secret, or other intellectual property right;
- Contain personal data of third parties without a lawful basis;
- Advertise or promote illegal products, services, or activities.
5.3.5 Prohibited business conduct
You must not:
- Use the Platform for any purpose unrelated to professional business prospection;
- Allow third parties to access or benefit from the Platform using your account credentials;
- Circumvent applicable subscription quotas or usage limits through technical means;
- Use the Platform in connection with any fraudulent scheme.
5.4 Compliance with Laws
You are solely responsible for ensuring that your use of the Platform complies with all applicable laws, regulations, and codes of practice, including but not limited to:
- GDPR and applicable national data protection laws;
- French Loi Informatique et Libertés;
- Directive 2002/58/EC (ePrivacy) and national implementations;
- CAN-SPAM Act (if targeting recipients in the United States);
- CASL (if targeting recipients in Canada);
- Any other anti-spam, data protection, or marketing law applicable in the recipient's jurisdiction.
Ignorance of applicable law is not a defence under this AUP.
5.5 Reporting Violations
If you become aware of any conduct that violates this AUP, please report it promptly to abuse@ugc-platform.com. We investigate all credible reports and take appropriate action, which may include account suspension or termination.
5.6 Enforcement
Violation of this AUP may result in, at our sole discretion:
- Issuance of a formal warning;
- Temporary suspension of your account;
- Permanent termination of your account without refund;
- Reporting to law enforcement or regulatory authorities;
- Civil or criminal legal action.
We reserve the right to investigate suspected violations and to cooperate with law enforcement in any resulting investigation. We will preserve and disclose records as required by law.
5.7 Updates to this Policy
We may update this AUP at any time. Material changes will be communicated with at least thirty (30) days' notice. Continued use of the Platform after the effective date of any update constitutes acceptance.
